The Mentally Impaired Accused Review Board (the Board) is established under section 41 of the Criminal Law (Mentally Impaired Accused) Act 1996 (WA) (the Act) and is governed by the provisions contained within it. The Act relates to criminal proceedings involving mentally impaired people who are charged with offences and subsequently found unfit to stand trial or acquitted by on account of unsoundness of mind.

All references to the defendant, as in the Criminal Law (Mentally Impaired Defendants) Act 1996 (WA), have been amended to the accused, as in the Criminal Law (Mentally Impaired Accused) Act 1996 (WA), pursuant to the Criminal Procedures and Appeals (Consequential and other Provisions) Act 2004 (WA) assented to on 16 December 2004 and which came into operation on 2 May 2005.

The Magistrates Courts and Tribunals directorate within the Department of Justice provides joint administrative support to the Prisoners Review Board, the Supervised Release Review Board and the Mentally Impaired Accused Review Board.
